ISS Previous Year Paper 2021 GS Solution Question

Q.4(a) “The Indian Constitution is a living document.” Discuss.

Answer :

The Indian Constitution is called a living document because it is neither rigid nor static. It has the flexibility to respond to new challenges while maintaining the fundamental values of democracy, justice, liberty, equality, and fraternity.

One of the key reasons for its dynamic nature is the amendment process under Article 368. Since its adoption in 1950, the Constitution has been amended numerous times to address emerging political, social, and economic requirements. Important amendments such as the 42nd, 44th, 73rd, and 74th Amendments illustrate its adaptability.

The role of the judiciary, particularly the Supreme Court, has further strengthened its evolving character. Through judicial interpretation, constitutional provisions have been expanded and adapted to modern realities. Landmark judgments such as Kesavananda Bharati, Maneka Gandhi, and Justice K.S. Puttaswamy have broadened the scope of constitutional rights and governance principles.

The Constitution has also accommodated changing societal aspirations by promoting social justice, local self-government, environmental protection, and digital privacy.

At the same time, the Basic Structure Doctrine ensures that while the Constitution can evolve, its fundamental features cannot be altered. This balance between continuity and change enables the Constitution to remain relevant across generations.

Conclusion

The Indian Constitution is a living document because it combines stability with flexibility. Its ability to adapt through amendments, judicial interpretation, and democratic processes has ensured its continued relevance in a rapidly changing society.
