ISS Previous Year Paper 2021 GS Solution Question

Q.4(c) “The Rajya Sabha has certain special powers vis-à-vis the Lok Sabha that adds to its prestige.” Comment.

Answer :

Although the Lok Sabha is often considered the more powerful House, the Rajya Sabha enjoys several unique powers that distinguish it from the Lower House.

Power under Article 249

The Rajya Sabha can authorize Parliament to legislate on a matter listed in the State List if it passes a resolution supported by not less than two-thirds of the members present and voting. The Lok Sabha does not possess this exclusive power.

Power under Article 312

The Rajya Sabha can empower Parliament to create All India Services in the national interest. Services such as the Indian Administrative Service (IAS) and Indian Police Service (IPS) derive constitutional support from this provision.

Representation of States

As the Council of States, the Rajya Sabha represents the interests of states in the federal structure. It acts as a platform for states to participate in national legislation and policy-making.

Permanent House

Unlike the Lok Sabha, the Rajya Sabha is a permanent body and is never dissolved. One-third of its members retire every two years, ensuring continuity in parliamentary functioning.

Revisory and Deliberative Role

The Rajya Sabha serves as a revising chamber that carefully scrutinizes legislation passed by the Lok Sabha. It helps improve the quality of laws through debate and expert discussion.

Limitations

However, the Rajya Sabha has limited powers regarding Money Bills and cannot determine the survival of the Council of Ministers, which remains collectively responsible only to the Lok Sabha.

Conclusion

The Rajya Sabha's special constitutional powers, federal character, and permanent nature enhance its prestige and importance in India's parliamentary democracy. Despite certain limitations, it remains a vital institution for legislative review, federal representation, and national governance.
